KS MEDIA — TERMS OF SERVICE

These Terms of Service (“Terms”) apply to photography services provided by KS Media. By booking, purchasing, or accepting photography services from KS Media, the client agrees to these Terms.
1. Services
KS Media provides sports photography services that may include game-day player coverage, premium player coverage, athlete portraits, team photography, event coverage, digital image delivery, prints, and other photography-related services.
The exact services, number of photographs, delivery timeline, and other details may vary depending on the coverage selected and the circumstances of the event.
2. Booking & Availability
Submitting a contact form, inquiry, or request does not guarantee availability or confirm a booking.
A booking is considered confirmed only after KS Media accepts the request and any required payment or other booking requirements have been completed.
Availability may depend on scheduling, event access, location, venue rules, and other circumstances.
3. Pricing & Quotes
Pricing for KS Media services may vary depending on the type of coverage, event, location, requested services, and other project requirements.
Prices provided through private inquiries or custom quotes are intended for the individual client and should not be treated as publicly advertised pricing.
Quotes are non-transferable and may not apply to another client, event, or future booking.
KS Media may change its pricing at any time. However, pricing changes will not affect an already confirmed booking unless the client and KS Media agree to a change in the services being provided.
4. Payment
Payment must be made according to the instructions and payment terms provided for the applicable service.
KS Media may require full or partial payment before photography coverage, editing, downloading, or final delivery is provided.
Additional services, additional editing, prints, products, travel, rush delivery, or other requests may result in additional charges when disclosed and agreed upon.
5. Cancellations, Rescheduling & Event Changes
Clients should contact KS Media as soon as possible if a game, session, or event is canceled, postponed, relocated, or otherwise changed.
Weather, event cancellations, schedule changes, venue restrictions, illness, emergencies, or circumstances outside the reasonable control of KS Media may require photography coverage to be changed, rescheduled, or canceled.
Any refund, credit, or rescheduling option will depend on the circumstances, the services already performed, and any terms communicated at the time of booking.
6. Event & Venue Access
KS Media must follow the rules and restrictions established by schools, teams, leagues, venues, event organizers, and other applicable organizations.
Booking photography does not guarantee KS Media access to sidelines, restricted areas, locker rooms, fields, courts, or other controlled locations.
If access restrictions affect coverage, KS Media may photograph from another permitted location or adjust the planned coverage.
7. Photography Coverage
KS Media will make reasonable efforts to photograph the requested athlete, team, or event.
However, sports are unpredictable. KS Media cannot guarantee that any particular play, touchdown, celebration, pose, interaction, or other specific moment will be photographed.
Factors such as playing time, athlete location, field position, lighting, weather, obstructions, event rules, and photographer access can affect the photographs captured.
8. Number of Photographs
The approximate number of photographs delivered depends on the service selected.
For services advertising an estimated or specified photo range, KS Media will make reasonable efforts to provide photographs within that range when sufficient usable images are captured.
The exact number may vary based on the event and circumstances of the coverage.
9. Editing & Creative Control
KS Media retains creative control over the selection and editing of photographs.
Editing may include adjustments to exposure, color, contrast, cropping, sharpness, composition, and other creative elements.
KS Media determines which photographs meet its quality standards for final delivery.
RAW, unedited, rejected, duplicate, test, or otherwise unfinished photographs are not included unless specifically agreed upon in writing.
Additional or specialized editing requested after delivery may be subject to an additional charge.
10. Delivery
Completed digital photographs are generally delivered through an online gallery, including services such as Pixieset.
Delivery times depend on the service purchased. Standard and priority services may have different turnaround times.
Any stated delivery period is an estimate rather than a guarantee when delays result from circumstances reasonably outside KS Media's control.
Clients are responsible for downloading and safely storing their delivered photographs.
11. Online Galleries
Clients may receive access to an online gallery where they can view, download, share, and, when available, purchase prints of their photographs.
Gallery availability and features may depend on the third-party gallery provider.
Clients should download and securely store their purchased photographs rather than relying on a gallery to remain available indefinitely.
12. Prints & Physical Products
Prints and other physical photography products may be available for purchase through the client's online gallery.
Some products may be produced, processed, shipped, or otherwise fulfilled through third-party providers.
Production times, shipping times, product availability, and other fulfillment details may therefore vary.
Any issue with a print or physical product should be reported as soon as reasonably possible so KS Media can determine what assistance may be available.
13. Copyright
Unless otherwise agreed in writing, KS Media retains the copyright to photographs created by KS Media.
Purchasing photography services or receiving digital photographs does not transfer copyright ownership to the client.
Instead, clients receive permission to use their delivered photographs as permitted under these Terms.
14. Personal Use License
Clients may generally:
Download and save their delivered photographs.
Share them with friends and family.
Post them to their personal social-media accounts.
Use them as profile pictures or other personal online content.
Order or create prints for personal use.
Unless KS Media provides permission, clients may not sell, license, commercially redistribute, claim authorship of, or use photographs for commercial advertising or merchandise.
15. Alteration of Photographs
Clients should not substantially alter delivered photographs in a way that misrepresents the original work of KS Media.
Removing a required watermark, selling modified versions, or representing substantially altered photographs as original KS Media edits may require permission.
Normal platform adjustments necessary for posting, such as reasonable cropping or resizing, are permitted unless otherwise communicated.
16. Commercial Use
Businesses, organizations, teams, sponsors, media organizations, brands, and other commercial entities may require separate permission or licensing to use KS Media photographs for advertising, marketing, merchandise, publications, sponsorships, or other commercial purposes.
Clients should contact KS Media before authorizing a third party to commercially use photographs.
17. Portfolio & Promotional Use
KS Media may ask for permission to display photographs on its website, portfolio, social-media accounts, advertising, or other promotional materials.
Where consent is requested or required, KS Media will respect the client's decision.
18. Client Information
Clients are responsible for providing accurate information when requesting coverage.
This may include:
Athlete or player name
Jersey number
Team
Sport
Game or event date
Event location
Contact information
Special requests
KS Media is not responsible for missed or incorrect coverage caused by inaccurate, incomplete, or outdated information supplied by the client.
19. Turnaround & Rush Services
Different services may include different editing and delivery timelines.
If priority or rush delivery is purchased, KS Media will make reasonable efforts to deliver within the stated priority timeframe.
Unexpected technical problems, emergencies, event circumstances, or other reasonable delays may affect delivery.
20. Technical Problems & Image Loss
KS Media takes reasonable precautions when capturing, storing, editing, and delivering photographs.
However, equipment failure, storage failure, file corruption, theft, accidents, or other unforeseen circumstances can occasionally result in photographs becoming unavailable.
If a significant technical problem prevents KS Media from providing a paid service, KS Media will determine an appropriate remedy based on the affected service, amounts paid, circumstances, and applicable law.
Nothing in these Terms excludes rights or remedies that cannot legally be excluded.
21. Client Conduct & Safety
KS Media may refuse or discontinue services when continuing would create an unsafe environment, violate venue rules, involve unlawful conduct, or subject the photographer or others to threatening, abusive, or seriously inappropriate behavior.
KS Media will not be required to enter restricted or unsafe areas to obtain a photograph.
22. Third-Party Services
KS Media may use third-party services for functions such as website hosting, payments, galleries, printing, communication, or order fulfillment.
Those services may have their own terms and privacy practices.
KS Media is not responsible for outages or other failures entirely outside its reasonable control involving third-party platforms, subject to applicable law.
23. Privacy
Personal information submitted to KS Media will be handled according to the KS Media Privacy Policy and applicable law.
Clients should review the Privacy Policy for additional information about how their information may be collected, used, stored, and shared with service providers.
24. Refunds
Refund eligibility depends on the circumstances of the order or booking.
Completed photography work and delivered digital products may have different refund conditions from services that have not yet been performed.
If KS Media is unable to provide a paid service, any applicable refund, credit, rescheduling, or other remedy will be determined based on the circumstances and applicable law.
A separate Refund & Cancellation Policy may provide additional details.
25. Limitation of Liability
To the extent permitted by applicable law, KS Media will not be responsible for indirect or consequential losses resulting from circumstances outside its reasonable control.
Nothing in these Terms is intended to waive or limit rights that cannot legally be waived or limited.
26. Changes to Services or Terms
KS Media may update its services, policies, pricing, and these Terms from time to time.
Updates to these Terms will apply going forward from their effective date. The applicable terms for an existing confirmed booking will generally be those in effect when that booking was confirmed, unless a change is required by law or agreed upon by the parties.

KS MEDIA — REFUND & CANCELLATION POLICY

KS Media understands that games, schedules, and plans can change. This Refund & Cancellation Policy explains how cancellations, rescheduling, refunds, digital photography orders, and physical products are handled.
1. Client Cancellations
If you need to cancel photography coverage, please contact KS Media as soon as possible.
Refund eligibility depends on how far in advance the cancellation is made and whether photography, editing, travel, preparation, or other work has already been completed.
Any non-refundable deposit or booking fee will be clearly communicated before payment.
2. Rescheduling
If a game, event, or photography session needs to be rescheduled, KS Media will make reasonable efforts to move the booking to another available date.
Rescheduling is subject to photographer availability and cannot always be guaranteed.
If KS Media is unavailable for the new date, any refund or credit will depend on the circumstances and any services already provided.
3. Game or Event Cancellations
If a game or event is canceled, postponed, relocated, or otherwise changed by the school, team, league, venue, or event organizer, please notify KS Media as soon as possible.
Whenever reasonably possible, KS Media will work with the client to reschedule the photography coverage or apply the payment toward another eligible event.
4. Weather Cancellations
Sports photography can be affected by weather.
If weather makes an event unsafe, causes the event to be canceled, or prevents photography from reasonably taking place, KS Media may offer rescheduling or another appropriate solution.
KS Media will not require the photographer to continue working in conditions that present a safety risk.
5. Cancellation by KS Media
If KS Media must cancel and cannot provide the photography service, the client may be offered:
A rescheduled date;
Credit toward another eligible KS Media service; or
A refund of the amount paid for services that cannot be provided.
The appropriate option will depend on the circumstances.
6. Digital Photography Orders
Because digital photographs cannot practically be returned after they have been delivered or downloaded, completed digital photography orders are generally non-refundable after final images have been delivered, except where required by law or where KS Media has failed to provide the purchased service.
If you experience a problem with your delivered photographs, contact KS Media so the issue can be reviewed before requesting a refund.
7. Before Photos Are Delivered
If a client requests cancellation after photography or editing has already begun but before final delivery, a full refund may not be available.
Any refund will take into account the work already completed, expenses incurred, and the circumstances of the cancellation.
8. Photo Quantity & Specific Moments
A refund will not normally be provided solely because a particular play, pose, celebration, or moment was not photographed.
Sports are unpredictable, and factors including playing time, positioning, obstructions, venue access, lighting, and event conditions can affect what can be captured.
KS Media will make reasonable efforts to provide the photo quantity and coverage described for the purchased service.
9. Editing Preferences
Differences in personal editing preferences generally do not automatically qualify an order for a refund.
If you have a reasonable concern about your final images, please contact KS Media. When appropriate, reasonable corrections may be made before other solutions are considered.
10. Prints & Physical Products
Physical prints and products ordered through an online gallery may be fulfilled by a third-party professional print lab.
Because many photography products are made specifically for each order, returns or refunds for reasons such as changing your mind may be limited.
If a product arrives damaged, defective, incorrect, or with a printing problem, contact KS Media as soon as possible with information about the issue so available replacement or refund options can be reviewed.
Third-party lab and fulfillment policies may also apply.
11. Rush or Priority Services
Fees paid specifically for rush or priority delivery may be non-refundable once priority editing work has begun.
If KS Media cannot provide the purchased priority service within the agreed timeframe for reasons within KS Media's reasonable control, contact KS Media so an appropriate remedy can be determined.
12. Event Access Restrictions
Schools, teams, venues, leagues, and event organizers may restrict where photographers are permitted to work.
If an unexpected access restriction prevents the originally planned coverage, KS Media will make reasonable efforts to provide coverage from an available permitted location.
Refund eligibility in situations where access makes meaningful coverage impossible will be determined based on the circumstances and services already performed.
13. Refund Processing
Approved refunds will generally be returned to the original payment method when possible.
Banks and payment processors may require additional time to make a refund appear in the client's account after KS Media processes it.
14. How to Request a Cancellation or Refund
To request a cancellation, rescheduling, or refund review, contact KS Media through the website's contact form and include:
Your name, email address, service or order, event date, and a short explanation of your request.
KS Media will review the circumstances and respond with the available options.
15. Policy Changes
KS Media may update this Refund & Cancellation Policy as its services change. The policy applicable to an existing confirmed booking will generally be the version in effect when the booking was confirmed, subject to applicable law.
